Membership Terms and Conditions

Terms & Conditions

These Membership Terms (Terms) govern the application for TEMiTalent Membership (Membership). It is your responsibility to review these Terms prior to your application for a Membership. By applying for Membership you agree to be bound by these Terms. We reserve the right to amend these Terms at any time and will provide the most recent version on our website.

Throughout these Terms, the terms “TEMi Talent”, “we”, “us” and “our” refer to The Employee Mobility Institute (TEMi) and its associated entities, and “you” refers to the individual or business purchasing a Membership.

  1. Application for Membership
    1.1. Our current Membership descriptions, entitlements and pricing will always be stated on our website located at https://temitalent.com.au.
    1.2. All applications for Membership must be made by filling out the membership form via our Website and chosen payment platform.
    1.3. All information you provide during the application process must be accurate and complete, and it is your responsibility to keep your details up to date.
    1.4. We will only process completed applications and reserve the right to reject an application for any reason.
    1.5. We will send you a confirmation email on payment of the applicable Membership Fee. Your Membership is deemed accepted on the day you receive the email.
  1. Membership Fee
    2.1. The Membership Fee may be paid by either:
    2.1.1. A single upfront annual payment via credit card via our Website and chosen payment platform; or
    2.2. A single upfront annual payment via bank transfer upon receipt of an invoice issued by TEMi. In the event an invoice is required, an administration fee will be charged.
    2.3. We may increase the Membership Fee from time to time. If we do so, we will give you at least one month’s notice of the intended increase by email and by notice on our Website.
    2.4. Minimum commitment is 12 months from initial joining date. Your annual fees are non-refundable if you wish to cancel your membership early.
    2.5. As a Member you have access to a range of member benefits which will change from time to time. This includes invitations to in-person social events which are conducted in major cities located on the Eastern Australian coastline.
  1. Membership Renewal
    3.1. One month prior to the anniversary of the date you joined TEMiTalent (Anniversary) you will receive communications from us advising you of your Anniversary data and the option to renew your membership.
    3.2.  You can renewal your membership via email at (temiconnect@employeemobility.com.au). Upon receipt of your notification we will raise an invoice and send this to you for processing within our payment terms.   Alternatively you can visit our Website and process a single upfront annual payment via credit card using our chosen payment platform.
  1. Refunds
    4.1. The Membership Fee is not refundable.
    4.2. TEMi Talent may offer a refund in special circumstances on a case-by-case basis. If you feel that you deserve a refund, you must contact us in writing outlining the circumstances to our Membership Experience Team (temiconnect@employeemobility.com.au) We will review your correspondence and advise our decision in writing.
  1. Privacy
    5.1. Personal Information provided by you during the Membership application process and throughout the duration of your Membership will be held and dealt with in accordance with our Privacy Policy, which is available on our Website.
    5.2. Without limiting our Privacy Policy, you consent to:
    5.2.1. Receiving commercial emails from us and our approved third party partners.
    5.3. You may opt-out of emails by updating your preferences or by notifying us directly.
  1. Conduct
    6.1. TEMi Talent does not take any responsibility or liability whatsoever for disputes between Members.
    6.2. By being a TEMiTalent Member and participating in TEMiTalent forums, events, social engagements or our training programs you must not:
    6.2.1. harass, abuse or harm other Members; send spam or other unwelcomed communication to other Members
    6.2.2. act in an unlawful, abusive, defamatory, discriminatory, or otherwise objectionable manner; or
    6.2.3. infringe the intellectual property rights of others, including those of TEMi Talent, Members or third parties.
    6.3. Should you attend a TEMi Talent Event, you acknowledge that TEMi Talent films and photographs every event. You consent to being filmed or photographed by TEMi Talent (or its representatives) and to TEMi Talent using your name, likeness, image and/or voice in such photographs or films for the purpose of promoting our events, services and products. No remuneration is payable for such use.
    6.4. We may revoke your Membership for any reason, including for breach of these Terms or for bringing TEMi Talent into disrepute.
  1. Limitation of Liability
    7.1. To the extent permitted by law, we exclude all conditions and warranties relating to your Membership.
    7.2. Where our liability cannot be excluded, such as in relation to Consumer Guarantees under the Australian Consumer Law or other prescribed terms under legislation, our liability for breach is limited to the Membership Fees paid by you.
  1. Miscellaneous
    8.1. These Terms shall in respects be governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts in Victoria to determine any matter or dispute which arises under these Terms.
    8.2. If any provision of these Terms is deemed invalid or unenforceable, all or part of that provision will be severed from the Terms and will not affect the enforceability of the remaining provisions of the Terms.
    8.3. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under the Terms shall not constitute a waiver of such right.
    8.4. These Terms constitute the entire agreement between TEMi Talent and you in relation to Membership.

HOLIDAY GIVE AWAY – TEMI TALENT LAUNCH

  1. The Promoter is: The Employee Mobility Institute (TEMI) ABN: 76 600 203 869 of registered office address: P O Box 5153, Frankston South, VIC 3199. The abovementioned companies will be hereafter jointly referred to as the ‘Promoter.
  2. Employees of the Promoter or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.
  3. To enter the competition an entrant must purchase a TEMi Talent Annual Membership at the introductory price of $AUD199.00 excluding GST (The Promotion Deal)
  4. Closing date for entry will be 4pm (AEDT) Tuesday 28th February 2023. After this date the no further entries to the competition will be permitted.
  5. No responsibility can be accepted for entries not received for whatever reason.
  6. The rules of the competition and the prize for each winner are as follows:
    • For each Promotion Deal purchased the entrant receives 1 ticket into the draw for a chance to win one of 5 x 4 days/3 night holiday accommodation prizes.
    • The entrant must have completed payment for their ticket to be valid.
    • For customers who are paying by invoice, the entrant must be within account trading terms of 30 days to be eligible to win.
    • The Promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control.
    • Any changes to the competition will be notified to entrants as soon as possible by the Promoter.
  1. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
  2. No cash alternative to the prizes will be offered. The prizes are not transferable.
  3. Prizes are subject to availability, and we reserve the right to substitute any prize with another of equivalent value without giving notice.
  4. Winner will be drawn at random at 4 Meadow Lane, Mt Eliza, Victoria on Friday 3rd March 2023.
  5. The winner will be notified by email and/or letter within 28 days of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
  6. The Promoter will notify the winner when and where the prize can be collected.
  7. The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
  8. By entering this competition, an entrant is indicating their acceptance and agreement to be bound by these terms and conditions.
  9. When claiming the prize, winners are required to register and then activate their voucher in line with the  Terms and Conditions
  10. The destinations may alter from time to time.
  11. All reservations require a minimum of 30 days advance notice to book.
  12. The competition and these terms and conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
  13. The winner agrees to the use of their name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current Australian data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.
  14. The winner’s name will be published on our website and media releases.
  15. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network. You are providing your information to the Promoter and not to any other party.
